Terms of Service

When booking a consultation with Restful Sleepers, the Client agrees to these Terms of Service:

"Restful Sleepers" is the trading name of Restful Sleepers NZ Limited. In these Terms of Service 'we', 'us' and 'our' refers to "Restful Sleepers".

“Client” means any person or entity engaging Restful Sleepers for their services as discussed in these Terms of Service.

General

The Client agrees to follow safe sleep practices in line with SIDS recommendations. Please click here to read more.
The Client understands the safety guidelines on co-sleeping and accepts that Restful Sleepers adhere's to safe sleeping practise which supports room-sharing, not bed-sharing.
The Client will disclose any medical conditions that their child has to Restful Sleepers.
The Client will not disclose any of the information they receive from Restful Sleepers to a third party, without Restful Sleeper’s prior permission.

Client Acknowledgement

The information provided in the sleep intake questionnaire is as accurate as possible to the Client’s knowledge.
If the Client’s child has a medical condition, the Client’s health care provider’s approval has been sought before commencing a sleep plan.
The Client acknowledges it is the Client’s responsibility to rule out any possible medical causes of sleep problems of their child (such as sleep apnea) as the child who has underlying medical causes of sleep problems may not be suitable to embark on a sleep plan.
The Client acknowledges it is the Client’s responsibility to ensure their child is gaining weight accordingly, thriving and otherwise well before embarking on a sleep plan.
The Client acknowledges that Restful Sleepers is not able to give medical advice and any questions or concerns that the Client has regarding the Clients child’s health will be under the Client’s health practitioners’ care. A sleep plan by Restful Sleepers is not intended to replace or substitute medical advice.
The Client acknowledges that Restful Sleepers will not be responsible nor liable in any event of injury or adverse events occurring while undertaking a sleep plan. The Client is responsible for the safety and health of Client’s child at all times.
The website may contain links to other websites that are owned and operated by third party vendors and other third parties (the "External Sites"). You acknowledge that Restful Sleepers is not responsible for the availability of, or the content located on or through, any External Site. You should contact the website administrator or Webmaster for those External Sites if you have any concerns regarding such links or the content located on such External Sites.

Payment

Full payment for all packages and follow-up support is required prior to consultation starting. Once payment is received in full the Client will receive acknowledgment of payment by Restful Sleepers. Phone consultations will be confirmed once payment has been made.
Package prices exclude GST.
Restful Sleepers reserve the right to alter prices at any time for any reason.
A sleep plan will not be issued or a consultation will not take place with outstanding invoices remaining. Restful Sleepers reserves the right to cancel a consultation if there is an outstanding balance owing at the time of the scheduled consultation.
Any outstanding debt to Restful Sleepers will be referred to debt collection agencies.
Payment is to be made in full via the website, using a secure Stripe payment system.

Cancellations / Refund Policy

Cancellations made more than 15 working days prior to a consultation will receive a full refund, less transaction fees.
Cancellations made less than 15 working days prior to a consultation are not eligible for a refund.
In the occurrence of sickness or critical events, Restful Sleepers can reschedule the consultation and cater accordingly.
Once the sleep plan has been received or a consultation has taken place, there will be no refund offered for change of mind.
If a support package is postponed for reasons agreed up by the Client and Restful Sleeper they forfeit the eligibility for a refund as above, from the rescheduled support start date (unless medically unwell).
If a support package is cancelled due to medical reasons and the Client has received the sleep plan their sleep support will be postponed to a date agreed upon by both parties.
Restful Sleepers reserves the right to cancel any package prior to the commencement of the home or phone consultation if they deem the package inappropriate for the Client. An alternative package may be suggested and the price difference refunded or the full amount refunded if Restful Sleepers or the Client chooses to forfeit the service engaged.

 Conditions of a Sleep Plan

Individual results may vary and results depend on many matters; including but not limited to, consistency, commitment, personal matters, approach to technique, technique or method, child’s needs, child’s age, severity of situation, following the plan correctly, communication to Restful Sleepers and the parents’ desire for change.
A refund is not offered in the event of the Client feeling dissatisfied and the Client understands that by embarking the plan that this is a risk taken.
Most Clients will see results within 10-14 days.
Restful Sleepers is obligated to keep up to date with current information, research and knowledge surrounding child’s sleep.
The Client understands that the customised sleep plan is meant for the Client’s child and the Client only, and should not be shared with a third party, the Client acknowledges the information might not be suitable for another child.
Any changes the Client makes to the Clients children’s sleeping or eating arrangements are the Client’s decision and Restful Sleepers will only make suggestions for change, of which the Client is responsible for choosing to implement.
It is the Client’s responsibility to contact Restful Sleepers for the Client’s follow up and to send the sleep log information through to be assessed for feedback as frequently as suggested.
Upon purchase to a sleep plan the Client is agreeing to these terms and conditions and privacy policy as outlined.

Restful Sleepers Complete Care Package (1:1 Package with Follow up support)

Full payment is required at time of booking
Once payment is made, there will be no refunds
There are no refunds or early cancellation of payment/s if the Client has a change of mind about the sleep service (see Cancellations below)
Restful Sleepers reserves the right to alter prices at any time for any reason.

Restful Sleepers In-Home Support

For clients that are considering booking in-home support or have booked in-support, Restful Sleepers will contact you via phone for a 15 minute consult at the time you have booked in for.
During this consult you will make a plan with Restful Sleepers for when the in-home support will take place. Restful Sleepers is typically available to attend the home consult within 1-3 weeks of the 15 minute consult, subject to availability.
The Client is responsible for informing Restful Sleepers who will be in the home during the in-home support and their relationship to the Client. If Restful Sleepers arrives at the home and does not feel it is appropriate or safe to enter the home, the in-home consultation will be rescheduled if Restful Sleepers deems it safe to do so.
If at any time during the in-home consultation Restful Sleepers doesn't feel it is appropriate to stay due to safety concerns; the in-home consultation will be concluded and rescheduling of the remaining in-home consultation will not be provided.
Refunds are not available for in-home support packages.
Travel costs are included in the package price (travel within 30 kilometres of Christchurch CBD). If the in-home consultation is to take place at an address outside of travel area there will be an additional fee of 83c per kilometre. This will be charged and invoiced prior to the in-home consultation. Payment is to be made in full prior to the commencement of the package.

Restful Sleepers Essentials Package

Full payment is required at time of booking
Once payment is made, there will be no refunds.
There are no refunds or early cancellation of payment/s if the Client has a change of mind about the sleep service (see Cancellations below)
There is no follow-up support included in this package.
Anytime within 3 months of the phone consultation, Clients are able to upgrade and purchase 2 weeks of WhatsApp support (Monday-Friday) and sleep and activity log review if they need further support and guidance from Restful Sleepers (subject to availability).
The Consult prices exclude GST.
Restful Sleepers reserves the right to alter prices at any time for any reason.

Restful Sleepers does not offer any medical advice, services or treatment to any Client. If you have concerns relating to a medical or nutritional issue we urge you to contact your GP or pediatrician immediately.
Restful Sleepers is fully covered with professional indemnity insurance and IICT insurance.
Changes to your baby's sleep or eating arrangements that may be suggested are at your discretion, of which you are responsible for choosing to implement.
The information provided on this website or by Restful Sleepers is not intended nor is implied to be a substitute for professional medical advice. The Client must always seek the advice of a GP or other qualified healthcare provider with any questions regarding a medical condition or the health and welfare of the Client’s baby, toddler or child.

Restful Sleepers will use all reasonable efforts to include up-to-date and accurate information during consultations and on this website, but makes no representations, warranties or completeness of the information provided.

Restful Sleepers shall not be liable for any loss or damages (including direct or indirect loss, or special or consequential loss) resulting from the Client's access to, or inability to access, this website, or from the Client's reliance on any information provided on this website or by the consultant.
This website or Restful Sleepers may provide links or references to other sites, but Restful Sleepers will have no responsibility for the content of such other sites or references and shall not be liable for any damages or injury arising from their content. Any links to other sites or references are provided as merely a convenience to the users and Clients.

Restful Sleepers owns all copyright in and to the content on this website and the materials, texts, advice, guidance, manuals, and technical information provided to you. The Client may download content only for their personal use for non-commercial purposes, but no modification or further reproduction of the content is permitted. The content may otherwise not be copied or used in any way without express written permission of Restful Sleepers or the author of any particular submission.

All materials are provided for non-commercial personal use only. The Client agrees that they will not copy, distribute or adapt the content for any other use, or otherwise compete with Restful Sleepers.

Restful Sleepers maintains this site for your personal information, education and communication. Please feel free to browse the site. The Client and any visitor to this website may download material displayed on the website for personal, non-commercial use, provided the Client also retains all copyright and other proprietary notices contained on the materials. You may not for any reason, however, distribute, modify, duplicate, transmit, reuse, repost, or use the content of the site for public or commercial purposes, including the text, images, audio, and video without Restful Sleepers written permission.

Confidentiality and Privacy Policy

I acknowledge that Restful Sleepers will uphold my case in confidentiality and discretionary.
I confirm that I will not share my child’s sleep plan or its content with any third party without Restful Sleepers permission to do so. By sharing the plan, it may not be in the third party’s best interest for the child as these plans are customised to each child’s needs.

Information we collect

Restful Sleepers will collect typical personal information including name, address, phone number, email address.

Restful Sleepers will use your personal information to create an online registration for you, to record and process your package for general communication. Restful Sleepers does not sell or rent your personal information to third parties.

Emailing tools

Restful Sleepers will communicate with you by email and may send you Newsletters and other marketing information. It contains an unscribe option.

Control of your online credentials

If you have registered online, you are responsible for all actions taken with your username, email address and password. If you choose to share your user name, email address and password or your information with third parties, you are responsible for all actions taken with this information and therefore you should review that third party's privacy policy.

Cookies

Cookies are small pieces of information that are stored in a browser-related file on your computer's hard drive when you use our website. We use cookies to improve the user experience. Cookies are widely used on most major websites. Restful Sleepers mostly use "session" cookies, which are removed from your computer after you leave Restful Sleepers. A second cookie is placed on your computer (if you choose) for Restful Sleepers to remember you, this cookie is intended to remain until deleted. These are used so our website can remember that you have logged in already and prevent you doing so more frequently. Square Space uses cookies for important reasons, such as: To provide a great experience for your visitors and customers. To identify your registered members (users who registered to your site). To monitor and analyze the performance, operation and effectiveness of Square Space platform.

Providing information

You agree that Restful Sleepers may provide any personal information it collects about you to its related companies (as defined in section 2(3) of the Companies Act 1993), debt collection and credit reference agencies and any other parties it deems necessary in relation to providing you access to this website, for any services from Restful Sleepers, to recover any money you owe to Restful Sleepers and to exercise any lawful right Restful Sleepers, its related companies or debt collection and credit reference agencies may have. You also authorise any person to provide Restful Sleepers with such information as Restful Sleepers may require in response to credit enquiries.

Membership removal

If you wish to have your registration removed from our directory for any reason, simply send us an email requesting to be removed

For users outside of New Zealand

Our website is operated by Squarespace from New Zealand. The information on our website may not be appropriate or available for use in other jurisdictions. If you choose to access our website from a jurisdiction other than New Zealand, you do so on your own initiative and you are responsible for compliance with any applicable laws of that jurisdiction.

Copyright and trade marks

We or our suppliers own copyright in the contents of our website. No part of our website may be distributed or copied for any commercial purpose and you are not permitted to incorporate the material or any part of it in any other work or publication (whether in hard copy, electronic or any other form) without our prior written consent. These terms and conditions in conjunction with our privacy policy form the entire agreement between us and you relating to our website and your use of the services.

General provisions

If at any time we do not enforce any of these terms or conditions, or grant you time or any other indulgence, we will not be construed as having waived that term or condition or our rights to later enforce that, or any other, term or condition.

Further, if any part or provision of these terms and conditions is considered to be invalid, unenforceable or in conflict with the law, that part or provision is deemed to be modified by a provision which, as far as possible, accomplishes the original purpose of that part or provision. The remaining terms and conditions will continue to be binding on the parties.

These terms and conditions are governed by and will be construed in accordance with the laws of New Zealand and you submit to the exclusive jurisdiction of the courts of New Zealand.

Severability

If any provision of this Privacy Policy is held to be invalid, void, unenforceable or illegal for any reason, such provision shall be deemed to be severed from this Privacy Policy and the remaining provisions shall continue in full force.

Access and removal of information

You have the right to access, change and delete personal information that Restful Sleepers holds about you. You can exercise this right at any time by emailing admin@restfulsleepers.co.nz updates to our information practices. From time to time, we make changes to our information practices or alter the functionality of our website. The last change to the Privacy Policy was in January 2025.
